Terms of Service

These Terms of Service ("Terms") govern your use of the Evocar website at evocar.app (the "Site") and, when released, the Evocar mobile application (the "App," and together with the Site, the "Services"), operated by CodeGray Inc. ("CodeGray," "we," "us"). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. The Services
Evocar is a Spanish-language study tool. The App is currently in development; features described on the Site, including planned content such as professional vocabulary decks, may change or may not be released. Nothing on the Site is a commitment to ship a particular feature by a particular date.
2. Acceptable use
You agree not to misuse the Services. This includes not attempting to disrupt or gain unauthorized access to the Services or their infrastructure, not scraping or bulk-extracting content except as permitted by a published interface, and not using the Services in violation of applicable law.
3. Intellectual property
The Services and their content — including text, card content, design, graphics, and software — are owned by CodeGray or its licensors and are protected by intellectual-property laws. We grant you a personal, non-exclusive, non-transferable, revocable license to use the Services for your own study. You may not copy, redistribute, or resell Evocar content except as expressly permitted.
4. Educational content, not advice
Evocar provides language-learning content, including vocabulary drawn from medical and legal domains. This content is for language study only. It is not medical, legal, or professional advice, and it is not a substitute for professional translation or interpretation in clinical, legal, or other high-stakes settings.
5. Disclaimer of warranties
The Services are provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that content will be free of inaccuracies.
6. Limitation of liability
To the maximum extent permitted by law, CodeGray will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from or related to your use of the Services. To the maximum extent permitted by law, CodeGray's total liability for any claim arising from the Services will not exceed the greater of the amount you paid us for the Services in the twelve months before the claim arose or one hundred U.S. dollars (US $100). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
7. Third-party links
The Site may link to third-party websites, including research publications. We are not responsible for their content or practices.
8. Changes to the Services or Terms
We may modify or discontinue the Services at any time. We may update these Terms by posting a revised version here with a new effective date; continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
9. Governing law
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles. Any dispute arising from these Terms or the Services will be resolved in the state or federal courts located in California, and you consent to their jurisdiction.
10. General
If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. These Terms are the entire agreement between you and CodeGray regarding the Services and supersede prior agreements on that subject. Our failure to enforce a provision is not a waiver of it.
